You are receiving this notice because you have submitted, or will submit, your candidacy for employment with Discover Financial Services or one of its subsidiaries or affiliates (“Discover”).  This Notice confirms the data collection process and background checking (if an offer is made) that will apply in connection with your application for employment with Discover (the “Application”).

In submitting your candidacy or completing the application form via Discover’s online applicant system, operated by Workday (“Workday”), you have supplied, and Discover and Workday will process, the personal data specified in this notice as part of the application process. Personal data collected at initial stages will include:

  • Results from any online evaluations you take as part of the application process (if applicable for certain positions);
  • Other information you include in your application, which might include a cover letter, resume, CV, or other supporting documentation
  • Whether you are aged 18 or over.
  • Whether you have relatives who work for Discover.
  • Work authorization/eligibility
  • Where required/permissible by law, your race, gender, disability, and veteran status

At a further stage in the recruitment process, Discover may carry out background checks (some of which may also, or alternatively, be carried out by a selected third party background check agency(ies)) in connection with the Application, which may require processing of additional personal data, including information regarding your criminal record. You will be notified and asked to consent to this background check at the relevant stage in the process in order for the recruitment process to continue.  We may need to disclose to such selected third party agency(ies) certain data relating to you to facilitate their carrying out of the relevant checks.  The background check requirement may cover the following information and sources if relevant, subject to applicable law:

Any personal data obtained in connection with the checks will be held and processed by Discover, Workday and, if necessary, the relevant background check agency(ies), in order to consider and process the Application with a view to Discover potentially employing you.

In addition, as part of the recruitment process, Discover may process additional information regarding your nationality and immigration status from related documents, such as your passport or other identification and immigration information, as provided by you.

We process your personal data on this legal basis so long as you do not object that these purposes are overridden by your interests, rights or freedoms.

In connection with the Application (and as part of the background checking process if applicable), we may also need to disclose personal data obtained to the following entities located outside the European Economic Area or the UK, as the case may be: Discover, background checking agencies and other third party sources of information, professional advisers, and regulatory and other competent bodies.  Data transferred to the above entities located in the US will be subject to adequate safeguards such as standard contractual clauses. Related evidence is available from Discover upon request. The laws and standards regarding data privacy in the US and other countries outside the EU and the UK do not necessarily provide a level of protection equivalent to the data protection laws and standards in the EU and the UK. Your personal data will only be used for the purposes set out in this Statement. However, we will disclose data where required to comply with law, for example with regulatory requirements and immigration approvals.

How long your personal data will be retained for depends on whether your Application is successful. If your Application is not successful, personal data from your Application will be kept in accordance with Discover policy, and as necessary for Discover to comply with applicable laws and regulations and to defend or prosecute legal claims. Discover may contact you about other positions for which may be of interest to you in the future. If your Application is successful and you become employed by us, personal data from your Application will be kept, during your employment and for a period thereafter in accordance with Discover policy, and as necessary for Discover to comply with applicable laws and regulations and to defend or prosecute legal claims.

We will ensure that appropriate technical and organizational measures are taken against unlawful or unauthorized processing of personal data, and against the accidental loss of, or damage to, personal data. We have in place procedures and technologies designed to maintain the security of the personal data processed, and will require that any third parties to whom we disclose personal data themselves put in place similarly adequate measures.

California residents may submit a request online to access, correct, or delete eligible Personal Information.  These rights may be subject to legal restrictions as provided by applicable law. Your Personal Information will not be sold to or shared with any third parties, service providers, or contractors.

For candidates located in the UK: 

While the above notice describes Discover’s data handling practices, Discover has some slightly different data handling practices for UK candidates. Notwithstanding the above, Discover does not collect veteran status, nor does Discover collect work authorization/eligibility at the initial stage of the recruitment process for candidates in the UK. In addition, where Pymetrics is used, please note that automated processing of personal data which is part of the online Pymetrics assessments we use on the Workday system, is not solely determinative of your eligibility to move forward with your Application. Discover always has professional staff review the outcome of the evaluation alongside other relevant eligibility criteria to make a decision on whether to proceed with an Application.

How long your personal data will be retained for depends on whether your Application is successful. If your Application is successful and you become employed by us, only relevant personal data from your Application will be kept, during your employment and for a period thereafter in accordance with Discover policy. If your application is not successful, your personal data will normally be kept for (a) six (6) months from the date of rejection of your Application, to be used only for the legitimate interest such as establishing, exercising or defending legal or administrative rights or (b) for twelve (12) months to be used to assess and notify you of any further vacancies at Discover which we believe may be of interest to you given this Application.

Data subjects in the UK have the rights below as applicable:

  • you have the right to request access to, rectification or deletion of your personal data;
  • you have the right to object to the processing of your personal data;
  • you have the right to request us to transfer your personal data to another controller;
  • you have the right to request us to restrict the processing of your personal data; and
  • you have the right to file a complaint with the Supervisory Authority, in the Member State of your habitual residence, place of work or where the alleged infringement happened.

The above rights are subject to legal restrictions, as provided by the applicable EU/UK privacy law.
